Important Dates for Divorce

As many people are now aware, changes to the Legislation on divorce will come into force on 6th April 2022. This is when no-fault divorce will replace the current divorce rules. This means that it will no longer be necessary to issue a petition on the ground of unreasonable behaviour, adultery, desertion, 2 years’ separation or 5 years’ separation.

If you do wish to issue divorce proceedings based upon the current grounds, here are some important dates for when you will need to file the divorce petition by:-

  • Digital applications must be submitted by 4pm on 31st March 2022
  • Paper Applications must be received by the Court by 4pm on 31st March 2022

However, unfortunately if applications are left until the last minute, then there is no guarantee that they will be issued ahead of the new legislation coming into force on 6th April. Therefore, it is better to complete your application sooner rather than later to ensure that it is issued by the Court in time.

The new paper and digital application will be available from 6th April 2022 in relation to the new Legislation. The online system is expected to be closed for a week from 31st March and so it will not be possible to access any new or existing applications during that time. Whilst this is not satisfactory, there is nothing to be done about it. We would suggest that any petitions based on the current grounds may need to be lodged online by the 24th March to hopefully be issued before the deadline.
