Parental Responsibility: Separated parents holiday rights UK

Where there are no court orders in place as to the time you spend with the children, each parent with parental responsibility should give permission to the children being taken on holiday. This does not apply to spending time in England and Wales.

You will not need consent if your partner does not have parental responsibility for the children. A mother will automatically have parental responsibility. A married father will have it, or where he is named on the birth certificate.

Where there is a court order in place providing for the children to live with you, it is possible for you to take them out of the country, for up to one month, without prior consent.

My ex-partner has refused to give permission, is there anything I can do?

Where a former partner refuses to give consent, it is possible to make an application to the court. This must be done in good time prior to the date of the holiday. You should also refer to mediation beforehand in an attempt to resolve matters by agreement if at all possible.
