Redundancy

A redundancy situation can arise in a variety of different circumstances but is often due to a downturn in business or through the closure or relocation of the company.

Whatever the reason, our experienced team of employment law solicitors understand how stressful it can be to be involved in a redundancy situation and are here to help.

What is redundancy and how does it work?

Redundancy is a type of dismissal where an employee is let go because their job is no longer needed by the company for various reasons, such as the company needs to reduce its workforce due to financial reason, or the redundancy results from the job becoming unnecessary due to restructuring.

The redundancy process involves:

  • Consultation – Employees must be consulted about the proposed redundancies.
  • Fair Selection – If there are multiple employees in similar roles, the employer must use a fair selection process to decide who is made redundant.
  • Last Resort – Redundancy should only be considered after other options have been explored.

What must be ensured before an employee is made redundant?

Although redundancy can serve as a valid reason for termination, it is essential for an employer to establish a genuine redundancy situation to ensure a justifiable dismissal. This means that an employee’s contract should not be terminated because they are disliked. The employer must adhere to a fair procedure, including consulting with impacted employees and actively seeking alternative employment opportunities.

How we can support you

Our specialist team of employment solicitors can support you through the redundancy procedure, ensuring that the process you are being subjected to is fair and reasonable.

Whilst we will aim to help save your role (assuming that is what you want), if your employment is terminated because of redundancy, we will also be able to advise you as to the next steps, including the possibility of pursuing an employment tribunal or by advising on the terms of a settlement agreement if one is offered by the employer.

"I have recently sold my property in Liverpool and Peter Caswell at Taylor Bracewell Solicitos acted on my behalf and he was outstanding. This was a very difficult sale due to the fact that the other party's solicitors was excessive in their demand and clearly ignorant but Peter was very patient during what ended up being a long drawn out process. Peter maintained professionalism..."
