Administering an Estate
The process of administering an estate is determined by what assets are held in the deceased’s name. It may be necessary to obtain a Grant of Representation – known as a Grant of Probate when there is a Will or a Grant of Letters of Administration where there is no Will.
However, the first step is to establish if there is a valid Will or not, and who therefore is entitled to deal with the administration of the estate.
That person is then personally liable to ensure that the estate is administered in accordance with the deceased’s Will, or if they didn’t make one, with the rules of Intestacy.
The list of jobs an Executor or Personal Representative has to do can be huge, and can be very time consuming.
