Are Electric Scooters Legal? Exploring Injury Claims and Your Rights

Electric scooters otherwise known as e-scooters are becoming a much more common sight on the streets in the UK in the last couple of years. This new mode of transport is excellent when obeying the law, however, are electric scooters legal?

In 2020, the UK government initiated trials for rental e-scooters, making it fully legal to ride an electric scooter on public land as long as it is part of one of these approved trials. However, the surge in e-scooter usage has unfortunately led to a rise in accidents, some resulting in severe and life-changing injuries. Similar to any injury caused by a moving vehicle, individuals who have suffered injuries due to an e-scooter are eligible to pursue the personal injury claim process.

In this article, we explain the law behind e-scooters and how to start the personal injury claim process.

Are electric scooters legal?

Electric scooters are categorised as Personal Light Electric vehicles and are subject to certain requirements. They must have a valid MOT, lights, number plates, and signals (including indicators and brake lights), and should be registered for road tax. Consequently, riding them on public roads, paths, or cycle lanes is illegal.

Currently, e-scooters are only permitted for use on private land with the landowner’s permission, unless they are part of a Government trial scheme. Failure to comply with these regulations can result in a fine of up to £300 and 6 points on your driving license.

What are the dangers of e-scooters?

While e-scooters are advertised as a new “eco-friendly” form of transportation, they can be extremely dangerous if not used correctly, posing risks to both riders and pedestrians. In the UK, individuals who have sustained injuries related to electric scooters are eligible to start a claim through the personal injury claim process.

E-scooters have the potential to cause serious injuries, including:

  • Brain-related injuries
  • Bone or muscle-related injuries
  • Spinal-related injuries
  • Life-altering injuries

These injuries often occur when e-scooters are used improperly. Following the law and following recommended safety guidelines significantly reduces the likelihood of riders causing harm to themselves and others.

Personal Injury Claim Process: Understanding the process

Sustaining an injury in any circumstance can have devastating consequences. In circumstances when you suffer an injury owing to the fault of a third party, you have the right to seek compensation for the losses, damages and suffering caused. It’s important to note that the law prohibits individuals involved in criminal acts from claiming compensation (known as ‘Ex Turpi Causa’).

If you have been involved in a collision with an illegal e-scooter, you may be eligible for compensation for your injuries and any resulting financial losses. We strongly recommend reaching out to a qualified personal injury solicitor within 3 years of the initial incident. A solicitor can provide guidance on the best course of action and initiate the personal injury claim process on your behalf.

"I have recently sold my property in Liverpool and Peter Caswell at Taylor Bracewell Solicitos acted on my behalf and he was outstanding. This was a very difficult sale due to the fact that the other party's solicitors was excessive in their demand and clearly ignorant but Peter was very patient during what ended up being a long drawn out process. Peter maintained professionalism..."
