The most commonly asked question when someone comes to us regarding a Medical Negligence claim is: “How long will it take to settle my claim?”. Unfortunately, it wouldn’t be helpful if I were to tell you that every claim will settle within a prescribed period of time.
At Taylor Bracewell we take great pride in actually focusing on the individual that has suffered harm through any circumstances. The individual and their recovery period dictates how long a claim will take to settle. We will not rush into settlement of any claim other than for your particular interest.
The general rule is that in all claims subjects to certain specific types of accidents such as on water or in air, but in most claims you have three years within which time to either settle your claim or issue court proceedings. If you issue proceedings outside of that time period, your claim may be defeated by a defence owned to the Limitation Act. Claims can take considerably longer than three years because of the injuries sustained.
