What is an executor?

An executor is someone who is appointed under the terms of a will. This is someone who is trusted to carry out the wishes once the testator passes away. An executor could be anyone from a friend or family member to a professional, such as a solicitor or an accountant.

Legal responsibilities of an Executor in the UK

An executor is responsible for organising the testator’s assets once they have passed away. First of all an executor will need to collect the assets of the testator, this includes cash in bank accounts, selling any property and selling any shares. These should be used to deal with any debts that the testator may have had, funeral costs, administration and testamentary costs. Legal responsibilities of an executor in the UK include establishing debts with an estate but they are not personally liable for the debts if there is insufficient assets. If there is more debt than assets the estate will potentially be insolvent. Once any debts have been dealt with the executor will distribute the assets to the beneficiaries, according to the will.

Transferring legal responsibilities of an Executor in the UK

It is possible for the legal responsibilities of an Executor in the UK to be transferred to someone else. This may need to happen if the nominated Executor is unable to act or if the matter is too complex, they may need assistance. The Executor can instruct a solicitor to assist them with the distribution of the will. For example, a solicitor may be instructed just to obtain a Grant of Probate on the behalf of an Executor or a solicitor may be instructed to deal with the entire administration of an estate.
