Separated parents: what do I need to do before taking my children on holiday?

Parental Responsibility

When taking children on holiday you must obtain written permission from anyone who has Parental Responsibility. A letter from the person with parental responsibility for the child is usually enough to show you’ve got permission to take them abroad. This letter should include the other person’s contact details and details about the trip.

Child Arrangement Order

If a parent is named on a Child Arrangement Order as having care of the child, then that parent may take their child on holiday without permission from their ex-partner for a period of up to 28 days. They are granted this right under the Children Act 1989.

What if the other parent does not consent to me taking my children on holiday?

If the other person does not consent to you taking the children on holiday, you will need to make an Application to Court for a Specific Issue Order.  You will need to give information about the intended holiday such as dates, flight times, hotel where you will be staying.

I do not consent to the other parent taking my children on holiday, what can I do?

If you object to a person taking your children on holiday you can make an application to Court for a Prohibited Steps to prevent them from going until matters have been looked into properly. However, the welfare of the child is paramount.
