Navigating Employment Law Night Shifts: Haunted by Overtime

As the moon casts its silvery glow and the world drifts into slumber, a dedicated segment of our workforce comes alive—the night shift workers. These unseen heroes, keep the cogs of our 24/7 society turning smoothly. However, the realm of employment law night shifts reveals unique challenges, especially when it comes to employment rights and protections.

In this article, we will explain the legalities behind working night shifts, ensuring employers are obeying the night shift regulations in employment law.

What are night workers & night shifts?

In employment law, night shifts are those who work during “night time”. Night workers are those who work for at least three hours during the “night time” on the majority of their shifts, or does so “as a normal course”. Case law suggests that anyone who works nights on one in three shifts or more will be a night worker.

Employment Law’s Night Shift Law and Regulations

Employment law governs night shift law, addressing crucial aspects such as working hours, rest breaks and the well-being of employees. Understanding these regulations is pivotal for the protection of employers and employees.

Here are some key aspects of employment law night shifts that all employers must follow:

  • Salary/Pay: Law states that National Minimum Wage applies to night shift workers, however, there is no mandatory higher night working rate.
  • Age Regulations: Night shift regulations state that those aged between 16-17 years old cannot work between the hours of 12am and 4am, unless they work in agriculture, sporting & advertising, a hospital, a hotel, retail and post. This only applies in exceptional circumstances.
  • Hazardous/Physically Straining Jobs: Workers who deal with specific hazards and/or mental or physical strain cannot work more than 8 hours within 24 hours.
  • Employee Records: Employers must legally keep a record of night workers shifts for at least 2 years, this is to ensure the regulations are abided by.
  • Health Assessments: Employers must offer workers a free health assessment before they begin working night shifts and then at regular intervals thereafter.
  • Rest Breaks: Night shift workers are entitled to one uninterrupted 20-minute rest break during any shift of more than 6 hours.
  • Contractual Agreements: Employers should provide night shift workers with clear employment contracts that outline their working hours, rest breaks, pay rates and any other relevant terms and conditions.

Staying informed about these key aspects of employment law night shifts is not just a legal requirement but also a step toward fostering a safe and equitable work environment for all.

This was a very difficult sale due to the fact that the other party's solicitors was excessive in their demand and clearly ignorant but Peter was very patient during what ended up being a long drawn out process. Peter maintained professionalism..."
