Resolution Good Divorce Week – Mediation

In 2022, Resolution are focusing on the Family Court backlog and how families can focus on out of court solutions, where appropriate and safe to do so.
One way of achieving this would be to engage in mediation. This is a process in which an impartial third person, being the mediator, assists families in reaching their own agreement about issues arising from their separation, such as in relation to children or financial matters.
Mediation can help reduce tension, anger and improve communication. This is especially important where there are children in the relationship. Mediation is available to married, unmarried and same sex couples, both before or after separation. Mediation takes place in private and in informal sessions. Mediation sessions can last one to one-and-a-half hours and there could be two to four joint meetings.
Legal Aid can be available for mediation, depending on income and capital and, if one party is eligible, it may also provide the other party with partial funding. The government also set up a mediation voucher scheme whereby, £500 mediation vouchers are available to separating couples, dealing with financial and children issues. The scheme has been extended to March 2023 and enquiries should be made with the mediator as to whether a voucher may be available.
